Terms of Hire
The terms and conditions of hiring our vehicles. If you do not accept these terms we cannot hire to you
1. Ownership and Responsibility
The Vehicle remains the property of Clydebank Vehicle Hire at all times.
The Hirer shall return the Vehicle, together with all tools, accessories and equipment, in the same condition as when received, allowing for fair wear and tear, to the location and on the date specified in the Rental Agreement (or earlier if requested). The Vehicle must be used in a reasonable and proper manner.
The Vehicle remains the responsibility of the Hirer until it has been fully inspected and accepted by Clydebank Vehicle Hire.
2. Permitted Use
The Vehicle shall not be used:
For any unlawful purpose or in breach of any applicable legislation.
For racing, pace-making, reliability trials, speed testing or driving tuition.
To carry more passengers or load than recommended by the manufacturer.
By any person providing false or fictitious information.
By any person other than the authorised Hirer or an approved additional driver.
By any person convicted within the last 10 years of driving under the influence of drugs or alcohol, dangerous driving, or who has had an at-fault accident within the previous three years.
By any person not holding a valid and appropriate driving licence (including D1 entitlement where required for minibuses).
By any person under 23 or over 75 years of age unless authorised.
By any person who has held a full licence for less than two years, has more than six penalty points, or holds endorsements beyond minor offences.
In any manner that would invalidate the applicable insurance policy.
Outside England, Scotland or Wales without prior written consent.
Where maximum payload or axle weight limits are exceeded. The Hirer is responsible for loading and unloading.
3. Hirer’s Financial Liability
The Hirer agrees to pay on demand:
All rental charges, including mileage and additional agreed services.
Additional daily rental charges for late returns beyond the agreed “Charge To” date.
All fines, congestion charges, penalties and court costs incurred during the hire period (subject to a £40 administration fee per notice).
Reasonable legal and recovery costs incurred in collecting outstanding payments.
The cost of repairing damage, subject to the applicable excess.
Insurance Excess
Unless reduced by purchasing Collision Damage Waiver (CDW):
£1,500 + VAT for cars and vans
£2,000 + VAT for minibuses and trucks
CDW reduces the excess in accordance with agreed rates.
CDW does not cover overhead damage. The Hirer remains fully liable for roof damage regardless of CDW purchase.
The Hirer is also liable for:
Tyre damage
Glass and light damage
Interior damage
Where gross negligence is determined, the Hirer shall be liable for the full repair cost or replacement value of the Vehicle.
The Hirer shall also compensate for loss of use while the Vehicle is unavailable for hire.
Fuel shortages will be charged at the prevailing rate plus a £10 + VAT administration fee.
Valeting charges will apply where the Vehicle is returned in an unacceptable condition.
All hires are subject to a cancellation fee. Cancellations made within 24 hours of the hire start time are non-refundable.
4. Cooperation in Claims
The Hirer shall assist in enforcing any rights or recovering losses from third parties. Any recovered sums shall be accounted for after deduction of outstanding liabilities.
5. Accidents and Damage
The Hirer must notify Clydebank Vehicle Hire immediately, and in any event within 24 hours (excluding public holidays), of:
Any accident
Any loss or damage
Any mechanical fault requiring repair
The Vehicle must not be driven if unsafe.
Repairs must not be undertaken without prior authorisation.
6. Personal Property
No responsibility is accepted for personal belongings left in or on the Vehicle. The Hirer indemnifies Clydebank Vehicle Hire against any claims arising from such loss.
7. Default and Recovery
The Hirer shall not sell, assign or encumber the Vehicle.
If the Hirer becomes insolvent or breaches this Agreement, the Agreement may be terminated and the Vehicle recovered. All recovery costs shall be payable by the Hirer.
8. Accident Procedure
In the event of an accident, the Hirer must:
Obtain names and addresses of all parties and witnesses.
Not admit liability.
Secure the Vehicle.
Contact Clydebank Vehicle Hire immediately on 0141 474 2141.
Notify the police where required.
9. Mechanical Failure
Vehicles are maintained in accordance with manufacturer recommendations. No liability is accepted for consequences arising from unforeseen mechanical defects.
10. Amendments
No alteration to this Agreement shall be valid unless agreed in writing.
11. Roadside Assistance Charges
The Hirer shall be liable for call-out charges and repairs where breakdown results from:
Incorrect fuel usage.
Battery failure due to negligence (e.g. lights or radio left on).
12. Abandoned Property
Property left in the Vehicle will be retained for 21 days prior to disposal. Disposal and cleaning costs may be charged where applicable.
13. Delivery and Collection
Delivery and collection may be available for hires exceeding three days, subject to availability and agreed charges.
14. Late Returns
Failure to notify of a late return may result in:
Additional daily rental charges at current rates
Late return processing fees
Returns exceeding 29 minutes without extension will incur a full additional day’s charge.
15. Data Protection
In accordance with the UK General Data Protection Regulation and the Data Protection Act 2018, Clydebank Vehicle Hire may process personal information for the purpose of providing hire services. Information may be shared for identity validation, insurance administration or where legally required.

16. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Scotland.
17. Information Sharing
If the Hirer breaches this Agreement, personal information may be shared with credit reference agencies, debt recovery agents, law enforcement or other relevant organisations where appropriate.
Important Insurance Notice
The Hirer must disclose all material facts that could affect insurance acceptance or assessment. Failure to do so may invalidate cover and may constitute an offence under the Road Traffic Act.
Insurers operate anti-fraud and theft registers and may share information in accordance with data protection legislation.
